A DCFS (Department of Children and Family Services) Appeal allows parents to challenge an indicated finding of a child abuse or neglect. Parents have 60 days to file an appeal from the date listed on the indication letter. A DCFS Appeal can either be resolved via a Mitigation Proposal, or via a trial which involves a hearing before an administrative judge. If unsuccessful, a subsequent appeal can be filed in the Illinois Circuit Court. In limited situations, the court may allow a foster parent or a relative to Intervene into the juvenile case. This means the court would make the foster parent or relative an actual party to the case. That means they can then file pleadings, attend court, cross examine witnesses, and make arguments and requests to the Judge.
